LUCKNOW || In the contempt petition filed by IPS officer Amitabh Thakur, the Lucknow bench of the Allahabad High Court on Tuesday issued contempt notice to Principal Secretary Home Debashish Panda.
The bench of Justice Devendra Kumar Upadhyaya said that the High Court had directed on 13 January 2016 that the departmental enquiry shall be proceeded only after providing all the documents to him.
Against this, the petitioner has presented a letter dated 02 May 2016 by Home Secretary which says that the documents from the districts would have been made available to him, which makes it clear that the State government was not sure whether the documents had been made available or not and yet the enquiry was re-initiated.
The Court said that in another petition, the High Court gave order on 26 April 2016 to start the enquiry but it could not have been made while violating the mandate of order dated 13 January. Based on these facts, the Court issued contempt notice to Panda seeking his reply.
